A court in Colorado has barred Donald Trump from being included on the state's presidential primary ballot.
An appeals court in Colorado issued a ruling on Tuesday, stating that Donald Trump will not be permitted to appear on the state's presidential primary ballot due to his association with the Capitol attack in January 2021. This unexpected legal decision, which the Trump campaign promptly announced it would contest, has the potential to disrupt the 2024 presidential election, where the former reality TV star currently holds a substantial lead as the frontrunner for the Republican Party nomination.
According to the Supreme Court of the State of Colorado, "A majority of the court holds that President Trump is disqualified from holding the office of President under Section Three of the Fourteenth Amendment to the United States Constitution. Because he is disqualified, it would be a wrongful act under the Election Code for the Colorado Secretary of State to list him as a candidate on the presidential primary ballot."The court's decision rested on the interpretation of the 14th Amendment to the US Constitution, which prohibits individuals from holding "any office... under the United States" if they partake in insurrection after taking an oath as "an officer of the United States" to support the Constitution. The lower court argued that the amendment does not apply to Trump since the presidency is excluded from the list of federal elected positions affected.
Noah Bookbinder from the campaign group Citizens for Ethics, the party bringing the case, celebrated the ruling on social media, describing it as "a significant moment for democracy." However, the court temporarily suspended its decision, anticipating an appeal to the US Supreme Court, a move immediately indicated by Trump's campaign.
Campaign spokesman Steven Cheung announced, "We will promptly file an appeal to the United States Supreme Court and a simultaneous request for a stay of this deeply undemocratic decision." Cheung criticized the "all-Democrat appointed" panel, alleging that it was serving the interests of a "(George) Soros-funded, left-wing group’s scheme to interfere in an election on behalf of crooked Joe Biden."
